Requirements for a Simple Divorce in Florida:
No minor or dependent children:
Both spouses must agree that there are no minor or dependent children from the marriage.
Agreement on all issues:
Both parties must agree on all aspects of the divorce, including property division, and any other legal matters.
Written agreement:
A written marital settlement agreement outlining the agreed-upon terms must be filed with the court.
Florida residency:
At least one spouse must have been a Florida resident for at least six months before filing for divorce.
No unresolved financial obligations:
Both parties must agree that there are no unresolved financial obligations between them.
Both parties must appear in court:
Both spouses must attend the final hearing to finalize the divorce.
Process for a Simple Divorce:
1. File a petition:
Both parties must file a petition for simplified dissolution of marriage with the clerk of the circuit court in the county where they reside.
2. Complete a marital settlement agreement:
Both parties must complete a marital settlement agreement outlining all agreed-upon terms of the divorce.
