    Register Your Mobile Home As Real Property

    Why It Matters

    In the State of Florida Mobile Homes are considered "Personal Property", similiar to a Motor Vehicle, that is why you receive a Title and Registration from your County's Tax Collector. If you reside in a mobile home park where you rent the lot but own the Mobile Home, you are subject to the "rental" agreement with the park owner and are renting the use of the land for your Mobile Home. In many situations, non-payment of the lot rent can result in the loss of the Mobile Home in very quick time frame, without the park having to go through traditional eviction proceedings. The State of Florida recognizes that many of its citizens reside full time in mobile homes and consider it their "Homestead". Due to this, there are Statutory protections for anyone who has declared their Mobile Home's address as their "Domicile", which is a fancy name for residency and has further properly registered the Mobile Home as "Real Property". When done properly, the Mobile Home is considered "Real Property" for purposes of claiming "Homestead" protections. This includes protections for non-payment of rent or from any judgment creditors.

    The Process

    It is a two-step process involving two (2) different County level offices. There are forms which need to be filled out and filed with each office.

    First a "Declaration of Domicile" needs to be filled out and filed with the Clerk of Court. This statement declares that the person resides in and maintains a place of abode in Florida, which they recognize and intend to maintain as their permanent home. There is no fee to file this document.

    Second "Declaration of Mobile Home as Real Property" gets filed with the County Property Appraiser's office if you own the "Real Property". There is a fee associated with filing this document. The Property Appraiser will issue a decal to be placed on the Mobile Home's plate with RP on the decal, which designates "Real Property"

    If you do not own the "Real Property" there are different requirements and Notices which can provide you with "Homestead" protections.

    You File Form #2

    You must go in person to the Property Appraiser's Office to file the 2nd Form and pay the fee. We provide everything you need to file in person.
